Activist Okiya Omtatah at the Court of Appeal on December 28, 2015, where he and the Judicial Service Commission had filed an application seeking to have the two Judges, Festus Azangalala and GBM Kariuki, retire, claiming that they were approaching the age of 70 years and would not give a fair trial in a case involving Deputy Chief Justice Kalpana Rawal.
