March 5, 1991: Gitobu Imanyara (left) the lawyer-cum journalist is charged with publishing seditious publications. A 31-member team of lawyers led by Dr. John Khaminwa appeared for Mr. Imanyara in Chief Magistrate’s court where he was also charged with publishing a newspaper without a duly executed bond. Chief Magistrate Omondi Tunya struck out the names of six other lawyers seeking to join the 31 as they were not in court when Mr. Imanyara’s name was called out. At the same time Mr. Imanyara, the Editor-in-Chief of the Nairobi Law Monthly magazine was charged together with his publisher Mr. Dominic Kenneth Martin (right)with falsely and maliciously publishing a seditious publication, issue number 30 of the Nairobi Law Monthly, last month. The issue allegedly contains, on Page 2, a seditious editorial entitled “Tribalism”. He is said to have published it with a seditious intention in order to bring into hatred or contempt or to excite disaffection against the Government of Kenya.
