May 30 1994: Two separate petitions challenging President Moi’s election to the leadership of Kenya are thrown out by the High Court. One, filed by Ugenya MP James Aggrey Orengo (FORD-K), had argued that according to Section 9(2) of the Constitution, amended in 1992, President Moi’s election was void as he had already served the maximum two terms. Another petition, filed by the boss of the Party of Independent Candidates of Kenya (PICK), Mr. John Harun Mwau, wanted the President’s election nullified because only Mr. Mwau, of the eight contenders for the presidency in 1992, presented his nomination papers in foolscap size as required by law. The three Judges rejected Mr. Orengo’s request that they declare President Moi’s election invalid or void following the August 1992 constitutional amendment which spelt out new Presidential terms.
