November 30, 1984: The High Court dismisses an election petition filed by Assistant Minister for Basic Education Dr. Julia Ojiambo. She had wanted the election of Assistant Minister for Tourism and Wildlife, Mr. Moody Awori, as MP for Busia Central constituency nullified. Said the three judges who gave the ruling: “The petition must be dismissed and we shall certify this determination to the Speaker, We shall also report in writing to the Speaker that no election offence has been proved. Justice H.G. Platt, Justice J. M Gachuthi and Mr. Justice William Mbaya heard the case for seven weeks. Dr Ojiambo called 27 witnesses and Mr. Awori 26 and the former Busia DC, Mr. Nicholas Mberia 16. The 21-page judgment lasted over an hour. In the elections held on September 26 last year. Mr. Awori polled 8,311 votes, Dr. Ojiambo 5.137 votes. In the photo, Mr. Awori celebrates the ruling with his supporters at the High Court.
